Intersections of GenAI and Cybersecurity: Reckoning and Responding to the Risks

The rapid emergence of GenAI tools challenges counsel and courts to determine whether and when they may responsibly use GenAI tools. This program aims at enabling judicial clerks, judges, and counsel at all levels to make such decisions, by presenting an in-depth update of the current capabilities, limitations, and risks of GenAI tools and of accompanying cybersecurity and ethical risks.

A Turn Toward History: Freedom of the Press at the Founding - Recently, the Supreme Court has embraced history as determinative of the nature and scope of the Second Amendment. In doing so, it has suggested that such a standard "accords with how we protect other constitutional rights," including freedom of speech and of the press. Whether we can expect historical primacy in the First Amendment context is still to be seen. In the meantime, this webinar discusses what interpretation of the First Amendment guided by a historical understanding might look like. It focuses specifically on the Press Clause, discusses scholarship on the question, and offers tips for historical research in service of litigation goals.
